The Prosecutor's Office's attempt to prevent the Constitutional Court from ruling on the legality of the parliamentary elections held in October 2024 is a gross encroachment on what is left of the democratic order and the rule of law in Bulgaria.
This was warned on "Facebook" by the "EU Law" lecturer in Alma Mater Hristo Hristev.
This act, unprecedented for the entire period of democratic development of the country after 1989, is a clear sign that we are no longer simply in an increasingly deep crisis of the rule of law, but are facing a threat to the existence of democracy in Bulgaria in general.
Through an orchestrated behind-the-scenes operation, the prosecutor's office has clearly been used as a pawn in an attempt to prevent the supreme body, called upon to guarantee the rule of law and legality in the country, from fulfilling its constitutional mission and obligations.
Whatever criticisms we may have of the work of the Constitutional Court, we must realize that if there is no categorical reaction against the attempt by the prosecutor's office to make it impossible to resolve the dispute over the legality of the parliamentary elections and whether the country's governance, at least nominally, stems from the actually expressed will of the citizens, we can consider that with the rule of law, and and democracy in Bulgaria is over.
I hope that this will be an occasion for the members of the highest constitutional control body to finally realize that the main threat to the existence of a full-fledged rule of law in Bulgaria is precisely the way in which the prosecutor's office is organized and functions according to the 1991 Constitution.
It is already obvious to the blind that with its current position, structure and powers, a true rule of law and the rule of law in Bulgaria is simply not possible.
