"I hope that morality will be shown and that a chief prosecutor will not be elected. This would be an extraordinary devaluation of the law", lawyer Ina Lulcheva told BNR.
"Law is nothing without ethics, and it requires that no one submit their candidacy to a body that is illegitimate and acts outside of its mandate, there is no trust in its decisions, there will be no trust in the selection of the highest levels – President of the Supreme Court and Chief Prosecutor".
Borislav Sarafov has shown for a year and a half that he has no desire to deal with the main problems in the prosecutor's office, Lulcheva said and pointed out that these are the existence of dependencies, the existence of circles, the initiation or termination of cases without grounds.
She described the concept he presented as "extremely disappointing".
"Suddenly it turns out that the problems are in the urgency of the investigation. It is proposed to abolish all procedural time limits, leading to eternal defendants and corpse cases. It is said that the possibility for the accused, as well as the victim, to get acquainted with the materials of the case, when the pre-trial proceedings are over, should be removed. The problem of experts was raised and it was said that it would be solved by creating a center at the Ministry of Justice where they would be trained. The problem is that there are no experts because engineers are not trained, doctors are not trained – pathologists, not enough accountants. This problem will not be solved by creating a hub.
The concept does not make it clear why any measures are proposed and what the real problem is in the fight against crime. There is not a single word about corruption crimes inside.
There are also good things about the concept – the idea that electronic cases should be introduced in pre-trial proceedings, to criminalize new forms of crime. This is correct, but it does not solve any of the prosecution's problems. There is no connection between the data being presented and the suggestions being made. This concept and its comparison with that of Ivan Geshev shows that concepts have no meaning".
Sarafov proved that he does not want to deal with the vicious phenomena in the prosecutor's office by not dealing with the "Eight Dwarfs", lawyer Lulcheva also stated in the program "Sunday 150".
"He suggests that the prosecution does not give reasons for its refusals. This is absolutely intolerable. Arbitrary form can be obtained".
It is my deep conviction that political influence in the prosecutor's office is still visible, lawyer Lulcheva emphasized.
"Both Ivan Geshev admitted to political influence when he was removed, and Borislav Sarafov when he took office. This is most clearly evident in the detention of MP Jeyhan Ibryamov - without permission from the National Assembly. A deputy cannot be retained for whom the National Assembly has not given permission. And the court served politics in this case".
