The decision is political, from a legal point of view there is nothing to comment on. It is a hostage to the negotiations. This was stated by Anton Stankov, former Minister of Justice, on BNT.

„The adopted changes in the legal commission are strange and laconic. The problem is quite personalized. A matter of yet another political backstage”, he believes.

Adv. Emil Georgiev from „Justice for Everyone” drew attention to “It is strange how the amendments from the ITN remained orphaned in the committee, after their submitters abandoned them. The main problems – they remain.”

According to Stankov, surprises can be expected in the plenary hall. “The absurdity of the case is that we have a constitutionally designated body – the Supreme Judicial Council, with an expired mandate, and we criticize it for how immoral it is to fulfill its constitutional obligations, without the constitutionally designated National Assembly having formed the new National Judicial Council.”

”If the provision that states that the National Assembly must fulfill its obligation is important – if it were not there, but an active procedure before another body was terminated, then we would have legislative arbitrariness, which exposes the legislative amendment to falling before the Constitutional Court. There is a lot of sense in this provision, the question is whether the National Assembly will fulfill its obligation,” Georgiev added.

According to “Justice for Everyone”, the figure of the Prosecutor General should not exist at all.

Stankov disagrees with this position: “One must know history.”
