Is there a way out of the impasse in the parliament? Even without a Speaker of the National Assembly being elected, a cabinet can be voted in, constitutionalists commented to bTV.
Before that, however, several conditions must be met.
"The clock of Parliament cannot remain stopped indefinitely. The Constitution provides a way out of the situation," commented Orlin Kolev, professor of constitutional law.
However, before the president begins consultations on forming a cabinet, the parliamentary groups must be constituted.
„Unifying into parliamentary groups, the president can start consultations with them, hand over the mandates to candidates indicated by the first, second and third groups. And if it is impossible to form a government, the way to the elections is open”, Orlin Kolev is categorical.
There is no term in the Constitution in which the President must be elected. However, there is no obstacle to form the parliamentary groups, and then the roulette with the mandates to spin.
„The President, on his own initiative, does not approve, nor allow, nor can oppose the will of the people's representatives to unite in a group”, Orlin Kolev also points out.
The delay in the election of the president has its own explanation, according to the constitutionalist prof. Plamen Kirov.
„Actually, the bet for the election of the president is the bet for the future acting prime minister”, believes Prof. Kirov.
Before the constitutional court, the president recently contested the texts of the constitution, which refer to the list of names from which the prime minister can be chosen. According to Prof. Kirov has another problem.
„I don't know how long this parliament can sit at the moment, because it is contested from the point of view of the legality of the elections we held”, explained the professor.
The Supreme Court has not ruled yet.
