Constitutional judge Borislav Belazelkov told bTV that the elections were overwhelmingly fair.
According to him, the Constitutional Court's decision that the election of 16 deputies was illegal means that the people's vote is legitimate, but there are violations that oblige the court to recalculate the result so that it corresponds to the vote.
According to him, there is a big difference between mistakes, violations and machinations. There were the most mistakes. “The main purpose of the election challenge procedure is to identify the errors. They have been identified completely and accurately in those sections for which there are justified complaints“, said Belazelkov.
He added that the recount takes into account the mistakes made by the section election commissions in the counting and counting of votes. There are also mistakes in the storage of ballots.
“The local authorities are to blame for storing ballots in sealed bags. And the SIC is responsible for what is in the bags. Not all bags have everything that is needed“, said Belazelkov.
What impressed the experts who reviewed the ballots was that a large number of them were filled in with the same handwriting.
With the Constitutional Court's decision, a copy was sent to the prosecutor's office to assess whether a crime had been committed. According to Belazelkov, it was not the prosecutor's office's job to interfere before the decision was made, but it did not interfere with anything.
„The prosecutor's office is not a security guard. A few months ago, it intervened in the case of a colleague from the District Court and the Supreme Judicial Council officially announced that this was inadmissible“, said Belazelkov. He added that it cannot interfere in another institution in a pending case.
The text of the dismissal of the Constitutional Court President Pavlina Panova is the opinion of the entire court, he said. The decision after that is unanimous. After it, there can be no cancellation of the elections, this possibility was explicitly rejected by the Constitutional Court. The reason is that there are not so many violations.
„There is no division in this case“, said Belazelkov. “How do you imagine that any of us will succumb to external pressure. Everyone does as they please, we do what we have to. We abide by the spirit of the law“.
According to him, whether the decisions taken with the participation of the 16 illegally elected deputies are valid is a question that can be raised before the Constitutional Court.
