The composition of the Supreme Administrative Court correctly ruled that an electronically submitted application for elections must be taken into account and so they ordered the CEC to register Peevski's DPS.
A panel of the Supreme Administrative Court incorrectly ruled that the registration of candidates for participation in elections is carried out according to the criterion of the order of submitted applications and that the later application of Dogan's DPS should be discarded, because the other one has already been registered DPS. However, the Electoral Code nowhere proclaims as criteria the time of submission of the application.
As a result of the scandal, DPS-Dogan will participate in the Alliance for Rights and Freedoms coalition, without bearing the abbreviation DPS, which is so valuable to this electorate, in its name.
However, the problem is that the problem was not solved, but remained. The participation of both Dogan and Peevski clans through their coalitions in the elections will remain illegal. Because in both cases they use the documents and registration of the same party - DPS. The Electoral Code in Art. 127 expressly prohibits this.
In summary I will repeat what I wrote some time ago:
„If DPS-Dogan and DPS-Peevski do not register two different parties, the Electoral Code will still be violated, because representatives of the same party, even if one does not have the abbreviation DPS, will participate in two different coalitions. Thus, the DPS party will enjoy an illegal, undemocratic privilege to come out with one breast in front of the other participants in the elections. Because it will gather votes both through one of its forms and through its other form, although their party essence is the same."
.
I ask a very simple question: what if later the two wings of the DPS collide again? Because, for example, they have now played theater on us in order to increase their election results in this way - the vote for them. Or because, as the interests have now divided between the two wings, although they were the same for a decade, they will then unite?
.
Breaking the law is capital in our country – by institutions, by court, by state bodies, by parties, by political actors. And if we look back in the coming years, the trend of devaluation of both democracy and statehood will clearly stand out.
