For more than 2 months, RIA, National Toll Administration, MRDPW and the Council of Ministers have been silent about the judgment of the Court of Justice of the European Union condemning the Republic of Bulgaria in Case C-61/23, Ecostroy, which was issued on 21.11.2024, by which the provisions of the Roads Act and the Road Traffic Act concerning the imposition of administrative penalties and compensatory fees are contrary to EU law.
This is stated by the Road Safety Institute.
As a result of it, all pending cases against Electronic Tickets and Penal Decrees will end with decisions for their annulment, while the EF and NP that have entered into force are subject to annulment, and the fines paid are subject to reimbursement. This will cause chaos on an unprecedented scale.
The Road Safety Institute has information about numerous cases in Bulgarian courts, as well as a procedure before the Court of Justice of the European Union against electronic tickets issued by RIA. According to the information provided to us by 13.02.2024, due to a gap in the Road Traffic Act and the Road Traffic Act, RIA and NTU did not have the right to issue electronic tickets for the violations they identified, which is grounds for the cancellation of each one issued for a violation committed before 13.02.2024.
We demand a response from the Prime Minister, Mr. Rosen Zhelyazkov, what actions will the state, represented by the Council of Ministers, the Ministry of Regional Development and Public Works, RIA, and NTU, take to resolve the situation that has arisen, is there clarity about the amount of expenses that it will expect to be paid and will the responsible persons be held accountable?
