Australian designer Katy Perry has filed a lawsuit against American music artist Katy Perry for violating her trademark rights, The Wall Street Journal (WSJ) reported.

Australia's High Court will now decide who "has the right to claim their name" - the singer who just went to space or the fashion designer.

Perry, an Australian who has owned her eponymous brand for years, claims that Katherine Elizabeth Hudson, also known as Katy Perry, has infringed on her trademark. The case has been pending in Australian courts for more than five years with mixed results. The designer eventually won the case in 2023, but an appeals court overturned the ruling last year.

Now Australia's highest court is reviewing the long-running dispute, suggesting that the appeal court may have relied on "a flawed assumption of fame that could endanger Australian brands," the newspaper said.

The dispute between them arose in 2009, a year after Capitol Records released the American's debut single, I Kissed a Girl. The star's representatives say they approached the designer to strike a deal over the use of similar names and surnames, but she refused.

The designer says she launched her label in 2006, and began working on it full-time in 2007. and finally registered the trademark in 2009. According to her, this was before the singer achieved success in Australia.
