On the occasion of the upcoming welcoming of Christmas and New Year, the team of the IA “Main Labor Inspectorate” (IA GIT) reminds that work done during public holidays is paid with a minimum double increase. If the work is also overtime, an additional 100% increase is due.

Of the upcoming Christmas and New Year holidays according to the Labor Code, the official ones are: December 24 – Christmas Eve, December 25 and 26 – Christmas and January 1 – New Year.

For those working on an irregular working day or on a daily basis, work done on public holidays is always overtime. This also applies to work on holidays and days off. Overtime work must be assigned by order of the employer, with which the workers must be informed at least 24 hours before the start of the work.

No overtime for scheduled workers – in the cumulative calculation of working hours, which is why they are only entitled to double wages when working on a public holiday.

For the eleven months of 2024. the control bodies of the IA GIT found 20,196 violations of labor remuneration. Of them, 8546 pcs. are related to the payment of additional remuneration to employees, such as work during public holidays and overtime work. Violations related to the payment of work during public holidays are 1,680, and those related to the payment of overtime work are 488.

In order to protect their rights to the fullest extent, workers and employees should have written evidence that they worked on holidays and non-attendance days, such as the overtime order or the roll call schedule. This will allow the control bodies of the Labor Inspection to carry out more effective control, including when a report is filed.
