"The significance of the case, the referral of the prosecutor's office to the murder of Capt. Marin Marinov in the Gaza Strip to begin an investigation, is a litmus test of whether we have justice," said Adv. Mincho Spasov in an interview with the Bulgarian National Radio.
He notified the Prosecutor General about the murder of Marin Marinov with copies to Jorge da Silva (Head of the UN Office for Project Services (UNOPS)) and Yosif Levi Sfari, Ambassador of Israel in Sofia.
"Art. 5 of the Criminal Code gives not only the right, but also the obligation for the Prosecutor General to investigate a crime against Bulgarian citizens when they are committed abroad", explained in the program "12+3" attorney Spasov, a former MP from the NMSV.
When asked whether this could happen with an investigation into the death of Marin Marinov, Spasov commented:
"The inferiority complex of the Bulgarian prosecutor's office is not a matter for comment. Art. 5 of the Criminal Code states that the powers of the Criminal Code also include investigating crimes committed against Bulgarian citizens abroad. Here why, given that a murder of a Bulgarian citizen has been committed and the Israeli side has no intention of conducting an investigation, does our prosecutor have to do so? In the signal to him, I suggest that he use the help of his fellow prosecutors from Great Britain, Moldova, France and Macedonia, whose citizens are also victims of a crime. At the moment, I have no feedback, but I hope to receive one from the Prosecutor General".
Mincho Spasov added that Marin Marinov is a UN employee and enjoys international protection.
"And in addition, Art. 116, para. 1 of the Criminal Code provides that the murder of a member of an international organization is a qualified case and is the most serious case of murder, which is punishable by life imprisonment under Bulgarian law,", said Attorney Spasov.
