The representative of the Supreme Judicial Council (SJC) Boyan Magdalinchev admitted the possibility that the procedure for electing a new Prosecutor General will be terminated. In response to a question from BTA regarding the changes to the Judiciary Act, he stated that there may or may not be an election.
Earlier today, the parliament decided that members of the Supreme Judicial Council with an expired mandate will not be able to elect a Prosecutor General and chairmen of the Supreme Court of Cassation (SCC) and the Supreme Administrative Court (SAC).
According to Magdalinchev, the vote is a legal absurdity, because if the mandate of one has expired, the mandates of all members of the council have expired.
We are ready for anything - to continue the procedure until the moment when the changes are published in the “State Gazette“ and to monitor what the National Assembly will adopt today. If the regulations are published, they have an imperative nature towards one person - the acting prosecutor general, Magdalinchev pointed out.
The purpose of this law is to prevent one candidate from participating in the procedure, he added.
According to another member of the council - Daniela Marcheva, it is also not ruled out that the procedure will be terminated. She asked for more time to familiarize herself with the texts of the law, but admitted that the case will be discussed at tomorrow's plenary session of the Supreme Judicial Council.
A law must be well thought out in order to be adopted, because when it is adopted in a hurry, there are always problems afterwards, said Daniela Marcheva, but pointed out that they cannot fail to comply with what the deputies adopted in the hall.
