Yanaki Stoilov: The Constitutional Court acts as a national sectional election commission - 1

This is a huge case, the most difficult factual case of the Constitutional Court (CC) since its establishment. This was stated to BTV by Prof. Yanaki Stoilov, constitutional judge and rapporteur on the CC case on the fairness of the elections for the 51st National Assembly, held on October 27, 2024.

The Constitutional Court issued a decision on the case yesterday and also declared the election of 16 members of parliament illegal. This is the largest partial annulment of a parliamentary vote so far.

As a result of this decision, the Central Election Commission announced (CEC) that with 107 votes the party “Velicie“ crosses the threshold of the parliament and will have 10 of its own MPs.

There are also shifts in the parliamentary groups themselves - six will leave and new MPs will come in their place.

“The reason for the severity of the case is not only the huge volume, but also the strong sensitivity, because the outcome of this case affects all parliamentary parties, in one way or another, and individual people“, specified Prof. Stoilov.

In his words, through the experts, the Constitutional Court acted as a national sectional election commission.

“From the very beginning, I have put before the court my opinion that after we finish examining the case and adopt decisions, we should send this report to the prosecutor's office – "such a letter is signed by the president of the court with a copy of the decision, in order to verify whether there is evidence of crimes committed," the constitutional judge specified.
