The Supreme Administrative Court /SAC/ finally overturned the decision of the Administrative Court - Sofia City and prematurely terminated the powers of Georgi Kuzmov as mayor of the Sofia district "Oborishte".
This means that there will be new elections in the Sofia district. Meanwhile, Kuzmov has returned and practically runs the municipality from the position of deputy mayor, appointed by his deputy.
"The evidence in the case establishes in an undoubted and indisputable manner that on the date of taking the oath, i.e. at the initial moment of the mandate, Kuzmov was a partner in two limited liability companies and thus falls into one of the alternatively specified hypotheses of incompatibility“, the court's decision from yesterday states.
Participation as a partner in a limited liability company also falls under the prohibitions under Art. 41, para. 1 of the LMMMA, insofar as it constitutes commercial activity within the meaning of the Commerce Act. The Commerce Act does not contain a legal definition of the term “commercial activity“. "According to the theory, any commercial activity is independent, aimed at making a profit and does not belong to the liberal professions," the decision, which is final, reads.
